Abstract:

The topic of special foreign investments and the untraded risks, which they may face in steward countries, make it necessary for us to investigate international legal rules of protecting foreign investments, which were reported in the international conventional rubes. Also, to investigate group treaties and agreements which concerned with protecting and assuring special foreign investments either nationally and internationally and to demonstrate legal rules of these agreements. This study refers to the more important separate, neutral international means in order to be used to resolve disputes which may arise between foreign investor and the steward country following the way of reconciliation and rule according to the agreement of constructing the international center (location) to resolve disputes on investment

الملخص

أن موضوع الاستثمارات الأجنبية الخاصة وما تتعرض له من مخاطر غير تجارية في البلدان المضيفة لها يقودنا إلى دراسة القواعد القانونية الدولية الخاصة بحماية الاستثمارات الأجنبية والمقررة بمقتضى أحكام العرف الدولي ـ وكذلك دراسة المعاهدات والاتفاقيات الجماعية التي عنيت بحماية وضمان الاستثمارات الأجنبية الخاصة سواء ًعلى المستوى الإقليمي أوالدولي وبيان الأحكام القانونية التي تضمنتها هذه الاتفاقيات ـ كما أن هذه الدراسة تشير إلى أهم وسيلة دولية مستقلة ومحايدة يتم اللجوء إليها للفصل في المنازعات التي تنشأ بين المستثمر الأجنبي والدولة المضيفة باتباع أسلوب التوفيق والتحـكيم وذلك بموجب اتفاقية إنشاء المركز الدولي لتسوية منازعات الاستثمار
